Consumer Fraud!

On 9 Mar my partner and that I joined in to a contract which needed a “refundable” $800 deposit (to cover-all appropriate costs associated with purchase) with Holiday Maximum to market our timeshare in Canyon River, Tx (view attached agreement). The salesman we were designated was Mr. Don Hansen. At that time we entered into this agreement, we were guaranteed that Holiday Max currently had a customer which was "prepared" to purchase, and also the home could be offered by June.in June, I approached Mr. Hansen and we were educated the purchase was pressed back and also the purchase could be finished from the end-of August. On 1 September I again approached Mr. Hansen at Holiday Maximum and we were educated the purchase could be finished by 1 October. On 11 Oct, I approached Holiday Maximum and was informed that there is another wait in purchase, but was guaranteed that it'd be finished from the closing week of December. On 4 January I approached Mr. Hansen, and that I was informed the customer backed out and Vmax would prosecute them for violation of agreement (it was a “open and closed case” per Mr. Hansen) plus they could be returning my $800 deposit within 75 - 3 months.in March I approached Mr. Hansen and he advised me the Holiday Maximum attorneys could be delivering me my money quickly. May came and that I again approached Mr. Hansen, and he explained the suit was still in lawsuit and that I would need to delay. 8 weeks later, at the conclusion of September, I had been informed the customer discovered a loophole within the agreement, as well as their match failed and that I wouldn't obtain any reimbursement. I've attempted many times to obtain them to return my deposit, but proceed to obtain stonewalled.
