Ripoff Restocking Fee on Defective Item Portland Oregon

This story is pretty much a rerun of Fred's story in Virginia except I actually got a defective product. I bought a Toshiba Laptop from Circuit City last week. I was aware of the "restocking fee" on opened items. Several days after I got the laptop it started shuting down by itself. Yesterday it shut down and would not power up anymore. I took it back and the store rep said they'd take it back minus the 15% restocking fee. I complained that the product was defective. They told me regardless, they will still charge me $180. I decided to settle on a the same unit so at least I'd still have a new laptop and no restocking fee. They didn't have any more in stock and told me I can wait several days to have it shipped or I can drive to one of thier stores in another city. 40 mins from where I'm at. I told them that since they don't actually have the same item in stock they should give me a full refund as the item was defective not because I changed my mind and wanted something else. 3 managers later... I was told that it cost them money to get it repaired and then resold as open box. I told the store manager that it's not my problem that they have to fix a defective unit. Why should I have to pay for something that never worked right to begin with and the same unit is NOT in stock. "it's our corporate policy blah blah blah". I do understand and can almost see the justification of a restocking fee if a customer just decided they didn't like the product. But on a defective item it doesn't matter how much money it costs them to repair or refurbish the product. It's not the customers fault that they sold a defective item. I will be disputing this with my Credit card company as I am being charged to restock a defective unit and like the previous poster... I've recieved nothing of value after being charged $180!!! The managers and employees of Circuit City are very well trained at reciting the 15% restocking fee policy when the time comes to use it. I will never again step foot inside a Circuit City store.
