Restocking Fee Charged For Defective Item

Yesterday I purchased an Apple iphone bluetooth headset. I was told I had 14 days to return the item. After charging the headset I attempted to pair it to my iphone but it didn't work. I returned the item to the store to verify that it was defective which they did however, when I tried to exchange the item I was told that I would have to pay a 10% restocking fee. I told them they couldn't charge a restocking fee for an item that they were not going to put back on the shelf since it was verified as defective. I attempted to return the item and was told the same thing. This doesn't seem fair since I originally didn't want to return the item I just wanted to exchange it for a working headset. The item was defective so I shouldn't be responsible for a "restocking fee"
