$1006.75 missing and I am getting a run around Fort Myers

The story starts on 11/20. I made my payroll deposit as I have always done at the ATM at Bank of America located on Winkler Ave.in Fort Myers Florida.

My account was in good standing by $1.49, the deposit amount was $1006.75 and $100.00 was made available to me and I continued my day as normal purchasing fuel and lunch in the early afternoon, until I attempted to make a purchase with my debit card later in the day and it came back denied. I figured that I must have demagnetized my card somehow and thought no big deal. I called Bank of America customer service and they told me my account has been closed. I became instantly irritated with this situation and began demanding answers, customer service redirected me to the risk dept. And I continued my interrogation trying to find out what is going on.

The woman I was speaking to told me that my account was being frozen due to check fraud from another bank, I lost my cool at this point and the risk dept. Hung up on me. I immediately checked for any active warrants for check fraud in my name, but as I thought there was none! I called the other bank in question and they said they did not know where B. Of A. Was getting their information from and there is no legal action against me, I thanked them for helping me in this matter.

The next day I called B. Of A. And attempted the exact same questions again and I was told it was because of NSF charges from another bank. They also told me that my account is frozen and will be closed on 12/9/08 and I will receive a check for the positive balance on my account 10-15 business days after closure. This is entirely unacceptable and I felt my questions have not been answered.

Later that afternoon I attempted to speak with another person regarding my account and I was told my account was frozen because my payroll check "looked funny" and they were unable to deposit $1006.75, I went to my employer to consult them about my check at this time and I was told by the personnel manager, who spoke to our payroll manager, that the check was good.

The next day I had calmed down some and I called B. Of A. Again and I was told by their risk dept. That the ATM where I claimed to have deposited my check was reviewed and THERE IS NO CHECK! I told them that I have a recipt for the deposit and a picture of the check printed on it. I was told that does not matter. Because of Bank of America I now have a negitive balance on my account and $1006.75 missing.

Someone please help me!
