ATM Deposit Check Rejected and Not Returned After Ten Business Days

I am a Bank of America customer and I have a problem with a deposit made on 04/22/09. I deposited a check made out to my wife and I into the ATM which we had done several times before. But the deposited was rejected because she is not on the account and I'm not upset about that part. But I am upset about the time it has taken for me to receive the deposit back.

It's been 10 business days and I have not yet receive the check back. The only answers I am getting is to keep waiting. This is a warning the check you deposit go to a processing center and not to Bank of America. And Bank of America has was their hand of any responsibility because I did not go into a branch and make the deposit. On top of that I got NSF fee the cash I took out from that deposit.
