Company didn't send phone, still charged & wants termination fee

In I ordered a phone from T-Mobile, which also obligated me to a 2-year service contract. I set up automatic bill payment at that time too. I never received the phone. I paid the $30 monthly charge (plus taxes & surcharges) for eleven months, assuming that once this got straightened out, we'd settle it. No one in customer service was willing to do anything to resolve.

After those eleven months, I terminated automatic bill payment. Within two months, a service contract fee of $300 was on my credit report as a delinquent payment. Despite the fact that I'd already paid over $350 to these people for nothing, they were insisting that I send another $300.

After another two years of going back and forth, with nothing ever getting resolved, I filed a complaint with the Michigan Attorney General's Consumer Complaints division. They just sent a complaint to T-Mobile.

I received a rude voice mail from Jonathan Lynch at T-Mobile (877-290-6323x8031) telling me that if I didn't get back to him within 24 hours that he'd disregard my complaint. I left 4 messages within that 24 hour period, and a few others. He clearly doesn't answer his phone. I never heard anything from him.

T-Mobile has stolen over $300 from me. T-Mobile has damaged my credit rating, costing me an unknown sum. T-Mobile continues to send to collections agencies the $300 they say that I owe for early termination of contract. T-Mobile has never made any attempt at any resolution (from offering to send another phone at a fee to an apology and correction).
