Directv broadband
Charged for service that was cancelled san jose california

I moved to a house a year ago. I called to have my internet access changed to my new address and phone number. Directv broadband said it was not offered at my new location, but wait a few days because new phone numbers don't always show up. I called Bellsouth DSL and they said my new address would be no problem, so I called DTV broadband back and cancelled my account. They said I had to fax or email them and I had the woman on the phone email me the cancellation form - already a hassle. The email came and I sent it back with my information. I thought it was done.

The next month DTV charged my credit card even thought it had cancelled the serice. I called them and they would not answer their phones (at least an hour on hold). I proceeded to call my credit card to tell them not to accept the charge. They said they could not do that, but I could dispute the charge. So I disputed the charge with my credit card company.

Over the next couple months DTV continued to charge my credit card and I continued to call, but the only person I could talk to was a "new service" operator who said she could not cancel and they were way behind in answering phone calls because they were in the process of taking over Telocity DSL.

In September I finally got through with who I needed to talk with at DTV. They said I never "officially" cancelled my service and because I was disputing charges they would not give me credit for the three previous months. They talked me into dropping the dispute, so they would credit back my account. I said "OK." I thought I was done.

They not only didn't credit back the previous three months, they began to bill my account in October and December. Of course, I was irate and called multiple times to no answer.in December, my credit card company and I got in a three way call with Dirctv broadband to get to the bottom of my dispute. At that time the representative from DTV said they could not pull up records from as far back as June because they were the property of Telocity. Therefore, she decided to refund back my service that I was not receiving. I thought I was done.

The next month I get a credit for December and October, but the three months previous to that were still on my credit card. Once again I called and DTV said whoever I talked to did not have the authority to credit back my card. Then DTV proceeded to tell me that because I had not sent back my modem they were going to charge my card $500. I said I would send back the modem when they gave me my credit. Then I called my credit card and cancelled it.

Now my cancelled credit card charges me $29 and interest every month that I don't pay for those original services I never received from Directv broadband.

I decided it was time to take legal action. I filled out a small claims lawsuit, however, I have to go to California (I live in Raleigh, NC). I have not decided whether it is worth it to travel accross country, but I don't know what else to do at this point. I am VERY frustrated.
