Terrible Return Policy

I purchased a Seagate external hard drive for my brother for XMAS from Dell. The order, payment, and shipping processes were executed perfectly. Unfortunately, my brother received 2 of the same product, so I offered to return the one I purchased. I just got off the phone with a Dell rep who very politely informed me that I was outside of the 21 day window and therefore cannot return the product at all. I understand the need to not have potential returns hanging out there all year round, but couldn't there be a penalty after 21 days (like a restocking fee) up until 60 days or something like that? Now I am out $70 and my brother is out 1 XMAS gift. I think this is a terrible return policy and a very poor reflection on Dell for a product that they don't even manufacture.
