Ripoff low life loan sharks took our vehicle, How could this company treat their customers in this manner ripping off the property that is more then half paid for

I filed bankruptcy due to a wage assignment that was placed on my paycheck. We called Americredit after my husband's dad passed away in March to get an extension.

The Americredit employee told us we are not doing extensions at this time but please try back in May of 03. Once again we were given the run around but continued to make payments.

The harassment began right after that and continued almost everyday. Several times my husband even called to get them to reason with us. Its tough when you fall a payment behind.

In Feb. 04 enough was enough and I filed. We continued to make payments on the 1999 truck. I was discharged at the end of June and two weeks later a repo man appeared and took our vehicle.

There was no prior contact by Americredit and they claimed we were three payments behind. I gathered all the bank money orders to show proof of our payments.

I spoke to Donna Mcclain who claimed to work in bankruptcy dept. She stated that if we are at fault we would return the vehicle. I waited five days then contacted her after not hearing from Americredit.

Our bank manager traced the money orders and it was Americredt which cashed them. The evidence was faxed to Donna Mcclain like she requested and she stated it would be reviewed by there research dept. There were still no results.

I then called Americredit and spoke to a person there who claimed there was no research dept. He then transfered me to Donna Mcclain. She now stated we needed $11,388.29 to get our vehicle back!

I then asked her why? She stated we violated the terms of our contract by missing a payment in May. I then stated you mean for one payment you are doing this to us? We will give you the payment just give back our vehicle!

She then stated maybe you should have thought twice before you filed bankruptcy. I told her I have been decent with you and have done what you have asked why are we being treated this way? She then stated that I told the bankruptcy judge I didn't want the vehicle

I then told her that is not true I swore under oath in front of the judge and my Attorney that I did want the vehicle. Donna Mcclain then said your lawyer did not file the affirimation papers to keep the vehicle.

I told Donna the reason why is your company never sent the papers or replied to the our Attorney. I then stated I suspect something is very wrong and I am going to get some legal advice.

Mrs Donna Mcclain then stated I wouldn't advise you to do that because it we get more costly and you will end up losing and wasting all that money. I told her what other option do I have?

You are stealing our vehicle. She then stated Americredit was in their right to take the vehicle. I asked her about all my personal property and she stated she would mail it to me!

I hung up the phone disgusted and angry. How could this company treat their customers in this manner ripping off the property that is more then half paid for. The vehicle was purchased in march and we have made all the payments but one.

Americredit does not work with their customers they are predatory lenders who soak you dry then take what little you have. I made several complaints. I contacted the Attorney General, the Commerece Commission and several other agenices after receiving a letter from Americredit.

It stated the vehicle would be sold at public auction and my belongings including work books would be disposed of. I called the repo thieves and they stated I needed $50.00 plus ten for everyday after. Boy you talk about a rip off.

These people they hire are low life scum bags who will steal the eye balls from a dead person. Americredit should be ashamed of themselves for the way they conduct business. John Mack an Attorney in town will take our case. He stated they have violated several laws and the civil suit will be at least $100,000, in compensation and other punitive damages. I was also made aware by the AG that I can file in court where a hearing will be held. It appears the judges on that panel will favor the consumer. I will keep you up to date after next weeks filing.
