Cars & Transport

I am a single mother with four children. My church assisted me with the purchase of a car from Zenith Auto Sales in March. On November 30, the engine went out. I had the car towed to another repair shop to get an estimate on the cost to repair. Mr. Mbah advised that he would have it fixed for me and would tack the payment on the end of my car note so that I wouldn't have to pay all monies up front. However, when I called him the next day, I was told he had left the country on business and would not return until late March. He left his representative, Emole, in charge of making the arrangements.

My car sat at the repair shop for approximately a month before arrangements were made to pick it up and, although, I was told I would receive a loaner car in the meantime. I never received one so I ended up borrowing my uncle's truck and eventuall renting a car. When the car was finally picked up, around Dec. 31st, I was advised that it would take approximately 3 days to put the engine in once he located one.

Every week that I would call, Emole would tell me that the car was going to be done. Emole told me he was going to buy a used engine to put in my car. I told him I wanted a new one. Later, he told me that he purchased parts to build a new engine and that's what was taking so long for my car to be fixed.

On Feb. 5th, Emole guaranteed that my car would be finished the coming weekend and told me to call him first thin on Feb. 7th, my son's b-day. Which I did first thing in the morning. When I called, Emole gave me the run around. Finally, I told him to take me to the repair shop so I could get the car. I had a driver with me to drive the car. He told me to meet him at the shop.

When I arrived, Mr. Mbah was there showing off cars to customers. He claimed that he had just gotten in the day before I arrived and didn't know what had been going on with my car. He asked me to let him handle everything from this point, but I told him that I wanted to go to the mechanic shop. When I arrived at the shop, my car was on blocks with parts inside the car, the trunk, and the old engine was still in the car. My front license tag was bent and the antenna had been broken off.

The mechanic said he'd received the car over a month ago. He was told by Mr. Mbah not to put the engine in and then he told him to go ahead and do it. He told me to call him on Tuesday to see if the car was finished. I went back to Mr. Mbah's shop. He guaranteed that he would have a car for me on Monday. When I called on Monday, Feb. 8th, he could not be found. When I called the mechanic on Tuesday, he could not be found. I sent a letter on February 12th via certified letter advising Mr. Mbah of his unfair and deceptive trade practice and that if I didn't hear from him in 60 days, I would have no alternative but to file a complaint.

I have not heard from him since. I was almost finished paying for that car and was looking forward to not having a bill. However, I ended up having to purchase a new car, with a new note, for 3 years and am therefore, in the process of hiring an attorney to file a complaint.
