In Violation of Feduciary Duty to Compensate Injured Parties

On April 9, a taxi cab took blind left hand turn into my lane causing me to strike his cab at approximately 10 miles per hour. He did not have the right of way, admitted fault by exclaiming "I did not see you". This was on Bay Street in San Francisco - the city known for no-left-hand-turn lanes. Bay Street is a four lane street with traffic traveling west and east bound. There are no left hand turn lanes on Bay Street either, so people performing left hand turn must yield to oncoming traffic.

I was on motorcycle mind you, so once I was finally calm we exchanged information and I even managed to get a witness statement.

On May 15, I receive a letter of denial from Mercury Insurance Group stating that I failed to yield to the right of way. As you may have guessed, this was drawn from some computer generated stock-text and has absolutely no bearing on what really happened. I am going to contest this decision as it is completely unfounded. A few search queries on google also revealed that Mercury Insurance is notoriously known for doing this.

But wait, the plot thickens. An agent representing Mercury Insurance, Belema Ogulu, told me to take the motorcycle to a local shop - I assumed to be examined by professionals. Now that they have denied the claim, probably standard procedure even with their DUI cases, they denied payment of the fees for examining the motorcycle. Now I am forced to flip a $155 bill.

The sheer incompetence and outright audacity these people exhibit are a tell-tale sign that there are serious flows in our current automobile insurance system. These people sound like mindless drones over the phone for fear of being held liable in the event of law suite. They read everything from a computer monitor. This woman, Belema Ogulu sounded like an automatron over the phone. I already had a suspicious feeling this was going to go south when the cab driver fabricated his witness. I watched him leave and NO ONE proffered their testimony. Who would - he nearly killed a motorcyclist.

My motorcycle, a rare RC51 race bike sustained thousands in damages - and here I am a victim twice over. If you work for Mercury Insurance group I do not understand how you can possibly sleep at night - you are the product of our current economic situation: greedy and no fiduciary duty to victims. These people are the worst kind of Americans in existence - and I mean that in worst possible way.

If you have any suspicions, take a look a Bay Street over google satellite - its just blatantly obvious their policy holder was at fault. There are absolutely no dedicated left-hand turn lanes - you must yield to oncoming traffic at all times.
