Ripoff consumer fraud ripoff Selling Used Cars as New

I had negotiated a deal on a "new" Mazda Protege 5 from this dealer. There was no Monroney Sticker on this car. According to the Federal Monroney Act of 1958, all new cars must have a Monroney Sticker attached to a side or front window. This sticker must contain, among other things, the vehicle's make and model, the final assembly point, its destination, the manufacturer's suggested retail price for the vehicle, and the manufacturer's suggested retail price for each accessory or item of optional equipment. The Monroney Sticker is named for Senator Mike Monroney of Oklahoma who is responsible for the legislation relating to these stickers. The absence of the sticker made me a bit suspicious.

I asked numerous times to see the sticker or an invoice since I wanted to confirm the accessories on the car. I finally asked for the VIN on this vehicle and began to search for it to no avail. I eventually called Mazda USA and once I gave them the VIN, Mazda USA informed me this car had been sold in October. It was now August. Mazda USA informed me further that this car was classified by them as used, it 36 month warranty went into effect as of its original sale date in October and since it was used it was not eligible for the 0% financing through Mazda credit.

When I confronted the dealership with this information (specifically the sales manager Nestor) he initially denied that it was sold back in October and this car was new.

I now realize thatthere are numerous cars in the "new" car lot of this dealership without Monroney stickers and I am concerned that this fraud is being perpetuated on others
