Ripoff bad faith fraudulent investigation false witnesses ripoff liars victimized us

My daughter had a car stolen December. It was a leased Honda Accord, I was the co-signor on the lease. We live in Eugene, Oregon.

My daughter, Kendra, was at the movies with her 4 year-old son. When she emerged from the movies the car was no longer where she left it. It had been discovered burned out near a boat ramp only a mile away. She is a Nurse's Aid and the loss of the car (only 2 days before Christmas) caused much in the way of problems and grief. She was completely reliant on reliable transportation and had always kept up her car and insurance payments.

The claim was denied for Material Misrepresentation and Fraud by the insurer, Progressive Insurance.
Progressive's Special Investigation Unit were asking for other people (like my wife and Kendra's husband) to be interviewed.

Since the car was taken we had not seen the remains, nor any photo's, until we got the Insurance company into arbitration. At this they presented an 'expert' from Texas, who showed that the last key used (using key path analysis) was her's.

Well, so what?

We did not accept the descision at Arbritration, and took Progressive to court. After a week-long jury trial we proved that the evidence showed that the car was stolen. We had to hire an expensive expert of our own, who showed that the car was stolen.

That's it, then, right? We proved the car was stolen in a jury trial. Proved that there was no fraud. Do we get the claim?

No.

They picked the fine print on the back of the contract. You have to comply with every reasonable request. So they pick someone you can't get hold of and want to interview them. You can't comply, so they deny!

So the bottom line is - you cannot win. We proved there was no fraud, proved we had a loss, and Progressive does not have to pay, because some one (that they picked as he could not be found) did not show up for one interview.
