Refuses to pay for totaled vehicle

My 2001 dodge durango was stolen - picked up 3 weeks later by the city pound, towed from the city pound to the insurance garage, 3 months later insurance refuses to pay claim for stolen vehicle that they deemed totalled.
Says i must sue them for the monies. I hired an attorney, filed a suit against them with the state dept of insurance, and you wouldn't believe how many times progressive has done this to people - refusing to pay claims until you sue for the money.
The judgement of the individuals in this company is unbelievable. Progressive should not be allowed to write insurance policies for anyone - ever. They will take your money without a problem, but when a claim is put in watch out. I'm in the lawsuit process now.
