$440 Refinance Fee Not Refunded After Loan Was Declined

I applied for a refinance of my home from CitiMortgage and was told by the loan consultant that there was a fee of $440, but that it would be refunded if my loan was declined. The fee was deducted two days before I got a letter saying that my loan was declined. It has been six weeks of weekly correspondence with the loan consultant, and I still have not received a refund, nor have I received any indication that it will be refunded.
