Ripoff

Used a local car dealer to lease a 1998 Doge truck. Lease was issued through north Island Federal Credit Union.

Telephoned North Island Federal Credit near the date of lease expiration in December and requested to purchase vehicle as contract stated that I had the first option to purchase vehicle if I chose to do. The pay off was $14,000.00, I made a counter offer of $10,000.00 and They reffered me to their outside contract service that handles lease vehicles.

I then returned the Vehicle to the purchase site after contacting the agent for NIFCU. He stated that he would pick it up in a few day's at the area we discussed, I also informed him that I wished to purchase Vehicle, He took down my offer and said that it sounded like a fair price and he would start the loan process.
In Janurary I had not heared from either party, I Telephoned the agent again for NIFCU, and spoke to the telephone messege service, as this was the party that was in charge of vehicle purchase now (as I had been informed by NIFCU) and stated that I would be able to negotiate the price, so I could purchase vehicle, please call me back to discuss terms.

Never got a return call. Then in march, three months later I was sent a letter of "loan denied" reasons were the three month's of non payment for the leased truck that had been turned in prior to lease expiration. It seems that they continued to charge me the monthly payment's (no prior funds were due or missed payments due). At that tme fuel was going up in the San Diego area and with Corporate gas company's charging. 20-. 25 cents per gallon more in San Diego because they can I decided the V-8 truck, would not be a good vehicle to fight over., especially when my buisness involves driving 60,000 miles per year around the county.
When NIFCU sent me a bill for 2,22.16 indicating a termiated lease date of 4-7, #1068911-C, this was 4 months past my lease contract date

I then went to an attorney as The represenitive for NIFCU stated to when I contested the matter. His exact words were "well get an attorney then" So I Obtained an attorney that reviewed the contract and case. He sent a letter representing myself and pointed out the Breach of Contract commited by NIFCU and that an offer was made to purchase the Vehicle.

NIFCU igfnored the fact that dispositin fee's that had been included in my monthley payments that they wanted to collect for again. Market Value of vehicle at that time was $20,000 plus versis the actual payoff of $14,000. Also nobody had indicated any fee's would be due at time of return.

I had fully performed all of my obligations under the contract, NIFCU most likley had mittigated any damages claimed by them thus offsetting proceeds from sale of Vehicle. Items like tire wear, minor grill work and outrages charges for 3 minor and typical dings a person gets while parking in public area's. We
Told NIFCU in writing that nothing was owed and itemized each charge in a letter sent by my attorney. With additional instructions that any negitive credit report would result in legal action. Well it seems NIFCU would like to give me lots of money, they have continued to report a negitve credit and let it compound ontop of itself until Janurary and made it a charge off.
I Have trie to contact my attorney but he is MIA and nowhere to be found, now I have to go through all of this again and take NIFCU to Superior Court. And I will not back from these crooks. The public needs to be aware of how these companies operate and not deal with these rip off artist.

I will update this if it goes all they to a Jury trial in the Superior Court's, as I am ready to let a jury and or the Courts deal with these Corperate slime balls. I expect that NIFCU will claim that it has just all been a paper error or blame it on some poor employee they will have to use as a scapegoat.
