Ripoff, caused emotional distress due to public humiliation and rudeness

I made a reservation at this motel on Worldweb Travel for an 8 day stay that we thought might be extended as we searched for housing near my new employment. The reservation specified a smoking room which was advertised as being available.

The day prior to our scheduled arrival, I had a minor traffic accident that added a day to our travel plans. I called WorldWeb Travel about whether there were any exceptions to the 3 day cancellation policy for the night in question. The gentleman on that line stated that it was up to the motel but that most would not charge for a later arrival date if there were circumstances beyond my control.

I called the motel and was told by the front desk clerk that Mr. Ibarra, the manager, refused to consider a refund. I changed my reservation to include only the three days that would have to be paid for under this policy.

When we arrived at the motel at 11PM after 8 hours of driving, we were told that the motel had no smoking rooms. We accepted that and took a room. After the first use of the toilet in that room, the toilet started to overflow. We called the front desk and were offered another room.

We moved to the 2nd room and in the morning discovered that the toilet in that room was also clogged. We again called the front desk and a plunger was delivered. We unplugged our own toilet.

Shortly after this, my sister, who has a severe allergy to mold, began having trouble breathing and we were forced to go outside so she could recover her breath.

I asked to talk with the manager. The front desk called to tell me that he had come in shortly after 10AM. We went to the front desk and spoke with Mr. Ibarra. I tried to explain our problems with the reservation and the room. Mr. Ibarra said, "How much toilet paper did you use?"

This upset me because my sister and I are both over fifty ladies, so I made a caustic comment to him. He became enraged and started shaking his finger in my face saying, "I could have you evicted... Don't you dare raise your voice to me." My sister tried to intervene to explain again the problems we were encountering at the motel.

Mr. Ibarra said that he had not talked to anyone about charging us for the day we were late (with the clerk I had spoken with on the phone standing right beside him). I turned to her and asked if she remembered our conversation. He interjected that he would not charge us for the missed night.

We had a few more words that ended with Mr. Ibarra saying, "I want you out of here right now. Pack up your things and leave." I paid him for the one night and left feeling humiliated and without a reservation in a town that was booked solid for the next 3 days.
