Checks Cashed Improperly

Bank of America cashed checks made out to my company for an individual.
This Individual had taken checks that were made out to my company and cashed them at B of A using an account he had set up there. The bank did not question that the checks were made out to my company and he was not my company.
I have tried to get B of A to resolve this since September 15 and they have artfully dodged their responsibility.
They now want me to contact the banks where the checks were written and have those banks contact the writer of the check and ask that person to file a complaint then have the bank submit the information to B of A and they will do an investigation and if they find a problem they (B of A) will send the money back to the originating bank who will then notify the original person who wrote the check and if he agrees they will reimburse the funds to that person then I need to ask for the money from that person. If they don't pay I need to take the original person who wrote the check to my company to small claims court. There are 100's of checks in total.
Bank of America should not be allowed to cash or deposit a business check to any person or account except to the account whose name is designated as payee.
They have violated a rule and now do not want to give me my money. They should go after the con man who they allowed to cash checks fraudulently. Currently he is incarcerated in California for this very thing.
It is thousands of dollars that are owed to me and I believe there is substantially more yet to be discovered.
