Deceptive Trade Practices - New agreement without my knowledge

I was a DirecTV customer for five years.

After months of problematic service, I called to cancel my service. They begged me not to and asked for one more chance at correcting the situation. I reluctantly agreed, but told them that this would be their final shot at salvaging me. If their solution did not work, I would cancel my service.

Their answer was to send me new equipment at no cost to me for leasing or shipping or anything else. (I have emails to confirm this.)

Upon receipt of the equipment, I installed it. It did not work so I called DirecTV to cancel and I told them I would.

The again begged me not to cancel and even offered me $100 in cash to remain with the service. I declined all offers as it was obvious that they couldn't fix the issues. They then notified me that I would be charged an early termination fee and the cost of the equipment, including shipping.

I reminded them that my agreement expired years ago and that they promised the equipment at no charge to me as long as I returned it at the termination of service. They told me that when I accepted the equipment, they automatically initiated a new agreement. What?!

I told them that I was never notified or advised of a new agreement and that I did not verbally authorize or sign a new agreement - why would I even consider this with the service being so bad? This is the best part - they told me that they didn't need my authorization because the information was posted on their website! Absolutely amazing! And, brazing to boot.

After numerous letters to DirecTV asking them to provide me with proof of an agreement between us, which of course they cannot, they maintain that I owe them $332.

If this isn't deceptive trade practice, I don't know what is. I know that the economic times are bad, but to resort to these tactics is outrageous and must be illegal. I'm asking for your help in getting DirecTV to see the error of their ways. My account should show a zero balance and I should not have to worry about a bad mark on my credit report.
