Ripoff Bogus Fast Gift Card Promotion

On 08May06 I bought over $5,000 of appliances including a Jenn-Air appliance qualifying for a promised $150 fast gift card rebate, which was a material representation on which I relied to make the purchase. On 11May06, I mailed all necesasry documents to Home Depot Promotion GCMT0501 PO Box 44329, Atlanta, GA 30336-1329 as required by the instructions, well before the 14Jun06 postmark deadline in the promotion.

Although the card is promised within 4-6 weeks, there is no record of receipt posted at the online site http://www.fast-giftcard.com/giftcardstatus and I am advised to check back in (exactly) 5 days. Repeated attempts over the past two weeks give the same results. I also mailed a copy of everything in the application on 11Jun06 to the same address with a letter of explanation in respect of the 14Jun06 postmark deadline.

The provided phone number 866-805-7328 answers with a promise of immediate Home Depot Gift Card customer service and then simply disconnects. Repeated attempts over the past two weeks give the same results.

Phone calls to the store are handled courteously but nobody appears to know anything about these difficulties or about any other complaints; genrally suggesting that I try again in a few days.

The problem is that this promotion also has a "receipt" deadline; the application must be "received" no later than 28Jun06 to be "eligible." This is promoted as a promise, not a contest. A very neat trick from a legal viewpoint.

I am willing to serve as a plaintiff in a promotion fraud class action against Home Depot.
