Ripoff, Overbilling on charges and cancelation fee due to bad service

About three to four months ago I gave my brother a cellular phone that and I paid the monthly fee which was to be about $37.10 only the first month the fee was 37.00 the next month it came up to about $257.00 and the next month to about $300 plus I called to cancell the service and called to verify with the brother about the calls. He tells me he had not made all those calls except 3 or four per day and very brief.

Contacting the Cingular wireless was useless since they said that the calls were made so it was my word against them they could not provide evidence that the calls were made from the phone. Since I had an automatic withrawal payment plan I called to ask them to put on hold the payment of the last two bills until this problem was resolved. Cingular went ahead and withdrew the money from my account about $650.00 on two months of service including a cancellation fee.

A contract exists if good service is provided and if you cancell without merit then I understand a cancellation fee but if the service is bad and you want to cancell contract you end up with a penalty of about $150.00 just for not accepting bad service.

At this time I am contacting a lawyer to recover my money back.
