Daniel Kidwell ripoff took my money and ran

I was in need of a 4 foot chain link fence for my yard. I went to the phone book and called several companies and got estimates. I also drove around my neighborhood, which is only 3 years old, and got names off of other fences that were installed.

I called Big D fence and he was a very nice man. He came he gave me my appraisal. My refinancing on my house was delayed and delayed and eventually it came through. I called him and told him I wanted to expand my fence due to the fact I wanted to put a pool in this spring. He gave me my new exstimate and that he would need 1/2 the money before he started that he would have it done in one day.

He was supose to start that weekend. He came to my house on Friday and said he needed the money to get the supplies and he would be there tomarrow. We were not going to be home so my husband paid for the fence in full (no my husband is not this dumb Daniel kidwell just seemed that trustworthy) No show no call. When I did get a hold of him he said he was in the hospital. Then he was coming out that wednesday. No show no call.
The huricane hit florida and we got some rain and high winds. I called him after all was clear not answer no answering machine.

Finally one night I got an answer. The excuse was the winds knocked out the phone lines. Well he was coming out that weekend. No show. No call. During several attempts to call and not get anyone on the phone. I went to the address on the contract only to find he did not live there for a year. His ex land lord was kind and gave me his current address.

I went to that. A young man answered the door and took our note asking Daniel Kidwell to call us. NO call. I called and accidentally got through and got an excuse. I asked him to please communicate with me so I knew what was going on. Finally I sent him a letter giving him 2 weeks to get my fenc in. I talked to him on the phone he said he would meet my deadline. Never heard from him again.

I called him and left him a message a genreic answering machine message asking him to call me with his intentions. Was he going to refund our money or give us a fence. No reply. It is now filed with the berkely county west virginia magistrates office.
