I'm not sure how much to put in monetary damages, either $59.90 (29.95 in Dec and Jan) or $1497.50 (50 months of $29.95). You see, the problem is that eHarmony SOMEHOW has managed to TWICE (once in 2007 and once in 2011) continue my membership even though my credit card on file had expired. Now, my card number DID NOT change, but the expiration date did. I did not transmit this information to them in nor did I in 2011.

Now, I realize that when they SOMEHOW figured out what the new expiration date was (and, perhaps, the CCID number), it was incumbent on me to close the account. I did not do this in and, subsequently, connected with the woman I am now married too... Quite happily. BUT, they illegally upped my expiration date until they found one which worked, twice.

In I DID attempt to close the account. I went to MY ACCOUNT SETTINGS, set the account for NON-AUTO RENEWAL, AND ALSO clicked on close the account. Because I had read that eHarmony has a history of continuing to charge credit cards when an account has been closed, I saved the screen page which showed that the account was set to non-renew. I did this with "Save Page As" within my browser, so that I'd have DATED proof of my action.

I received in my email a COMMUNICATION REQUEST from a woman who was interested in my eHarmony profile, which meant that eH had NOT closed my account. I wrote to Customer Care, and was told that:

"While reviewing your account, I see that you have not turned off the automatic renewal feature. This is the reason why your subscription has been renewed. I have gone ahead and turned off the automatic renewal feature for your account. Your subscription is now set to expire on 02/14. However, though your account is not eligible for a refund, we would be able to offer you a partial refund of 50% of your initial subscription price, for a total of $ 14.97 and closed your account."

Thank you eH. Closing the account is what I was trying to do and you refused to do initially. However, this did not address the issue that I NEVER transmitted the new credit card information to them.

I have PROOF that I did not do this. I NEVER opened the envelope which my bank sent to me, the one which contains the new card. Every other company with which I had an AUTO-RENEW had to be contacted so that I could give them a new account to do AUTO-PAY from. So, my bank records would show that this new card had NO ACTIVITY other than from eHarmony, AND, as evidence, I have the unopened mail from my bank with the new card inside.

I am presently looking for an attorney who would be interested in my hard copy evidence that eHarmony fraudently charged my credit card. I am also looking into what my State Attorney General's Office might be able to do.
