Over Charges on Yearly Condo Deposit Check

I moved back to the rea from reno on january and rented a condo from the Bennetts. The rent was extremely high for the region at over $1400 each month. I need a place and was in a rsuh so i signed the one year lease. I paid a chack og $975 deposit for possible damagesetc. Tne Benett's also have their own water supply and sewage company, which I am not sure is a legal business due to the management of the meter reads leading to abnormally high charges. I contacted the Bennetts in Novemebr and suggested that they lower the montly rate and i would consider staying on for another two years. Charlie said that could be done. I called him afetr receiving no response in 5 weeks and asked about the negotitaed lowering of ht erate, Charlie said everyone else would be raised and mine would remain the same. Within a week, i received a formal letter from he and his wife that the rates would be raised. I explained that i would be leaving and had located a house on Seneca Lake for $500 less a month. I told him I would be out of the condo by Decemebr 19th 2009. I cleaned the entire houyse and spackled all picture hanging nail holes. I am a very cleanbachelor and not one carpet was out of place. Please remember that the condos were built in the 1970s and had not been upgraded in any way so most of the utilities etc were totally beat including the stove, non-working dishwasher, extremely noist refrigerator, non-working toilet refill systems, pastel toilet fixtures with cracks, outer wondows that were not lockable, a water system business in my basement which ran and made noise 24/7, etc.

The first month I resided in the condo, the family water business charged me for 3,000 gallons of water use for January. I am a bachelor who definitely does not use 100 gallons of water each day. I work every day and seldom there on weekend. I complained as they obviously lied about the meter readings. The result was that I had no water bill for several months, but the issue is they disrespectfully mis-billed me for the water. Several times late in the year's lease months the reading was totally a lie concerning the meter read as this is an arbitrary reading by the owners and not open to myself to see, as I asked. The last two readings reflected over 1000 gallons for the month which is a physical impossibility because i wasn't at home from half on the time.

I turned off the electricity to NYSEG as of the 19th when I vacated the premises. I received a bill dated 12/29 thru 1/28 when I was gone and had the power returned to the Bennett's name. They charged me $10.17

I was charged $4.55 to replace the 1970s antique Jenn Air oven lite whcih I never used. I normally ate out.

I am a very neat and clean person and I never had somuch as a glass of water spill. I did hang sveral pisctures but I spackled every hole back to 100% perfect condition before I left. For the record, I rented a "brand new" condo in Reno for a year and when I was laid off and moved back to NY, I performed the exact same cleaning ritual, was returned my 0 of the deposit check of $1,000 and was told i was the best tenant he had ever known. Now, I am being presecuted financially for the Bennetts unscrupulous behavior on a totally used 1970's abode.

I was charged $700 to "one bedroom"1. Protect floors, furniture (which there was none), fixtures, hareware etc2. Patch all cracks, holes, dents etc and sand smooth. I will atest there was "no damages" of any kind. 3. Spot prime all patched areas4. Apply 1 finish coat to ceileing6. Apply 1 finish coat to walls7. Sand and vacuum trim8. Spot prime and bare wood on trim9. Caulk trim as needed10. Apply 1 coat gloss to trim11. Clean up

Also, 1/26 Prep and paint 2nd floor halls, 5 door and door frames, patch and paint ceiling in bedroom. This all totals 14 hours at $45 per hour which is $630 total, PLUS Mr Bennett forwarded the painetr a $10 tip. My bill states $700 for work which is ficticious or done as unneeded and unrequired maintenance. I will testify in court and have 5 or more witnessess available to testify that these repairs were totally unrequired and false accusations.

I cleaned the condo complete vacuuming, dusting etc. I received the charges of 3 hours cleaning at $25 per hour total $75. This was a 10 room condo so from the 3 hours required you can deem that it was hardly used and definitely not left in a dirty condition.

There is a bill from the All Surface Cleaners which clearly states "Estimate". All details are hand scratched in by Mr Bennet stating (the word estimate scratched) Bill / Receipt was Hard wood floors and downstairs basement, cleaned including garage (which I personally swept) and the total hand written at $243 which is completely fabricated, as is this entire bill listing.

Being very generous I would agree to have the Bennett's keep a maximum of $300 to clean their pastel 70's relic. This entitles me to receive a total of $575 back of my deposit check. I have received $131.44 which indicates that I must receive another $442.56 back of my deposit. What the bennetts are trying to do is very close to criminal and i am sure they wouldn't want an "over charging" landlord operating inn htis manner with them or their family?

I question the legality of the "family run" water utility business and the obvious mis stating fo the meter reads causing the bennet false financial gains? They should maybe be brought up to the utilities commission?
