Ripoff Took money and did not provide materials or labor No response

Found a Penny Saver ad for a contractor that installs AlumaWood patio covers. Terry Earp of Rock Solid Construction gave me an original estimate of $10,000 for a 12x50' patio cover—no deal. Then he came down to $5,500. We signed a contract. He took a personal check in the amount of $4,800 made out to Jesus Fuentes for the materials. Mr Fuentes cashed this check at a Bank of America on 5/17/06. Terry was to pour the footings Saturday 5/20 and install the patio cover today. I have no footings, no patio cover as of 5/23/06 and Mr. Earp is not responding to my calls.

I should have been more diligent and noticed no address on the letterhead of the contract. Neither Mr. Earp, nor his company are listed with local information directory. They are not licensed. All I have is a cell phone with my voicemails being ignored. I believe I will not see my money or the patio cover.

I report this as a cautionary tale to anyone dealing with independent contractors. ADVICE: Get auto lisence numbers, drivers license numbers, any information you can so you can track them down, if it comes to that.
