Alex crane, www.myspace.com/crane-computers mislead me on a sales did not replace computer modem lied about warrenty and replacement

I bought a computer modem off of alex crane of alexas computer repair and sales.,

When i ordered it he said that he was getting it from a internet site that has new refurbished modems and that it had a warrenty he stated if it stopped working in a year he could replace it with a new one well it quit in 3 months so he told me and few other people that he messed with the processor he speeded it up some how before he delivered it to me and that he would replace well first he said he sent it back to place that he got it and i would have another one in few days well after 9 weeks i kept calling his cell and home also emailing him with no response then finally was told he dont have the funds to replace it i gave him a choice either replace it with the one i bought or give my money back he tried to build me one out of parts he had laying around and i told him no that i didnt pay for one he built out of spaire parts now on 9/24 he told my son hes not replaceing modem and i can just sue him he is a small business with a tax number etc i know this because im the one who helped him get everything he needed to start his business there are other people whom he was paid for services and had that service not completed also what can i do about getting this resolved i have paper work to prove my case
