Flagrant backorder issues and refusal to refund $407.91 after cancellation and refund was promised

A flatware service for 12 was ordered from this company on December 30. Money from our credit card was taken out on January 8 in the amount of $407.91 for the aforementioned flatware.

An email was sent to them on February 8 inquiring about the date for delivery of the merchandise. On February 10 an email was finally sent back saying that the merchandise was on backorder to expect delivery in 2- 3 weeks.

They were called at the listed 800 number on February 12 at 1:40 PM EST and spoke with Carolyn. They were instructed to cancel the order. They agreed and told my wife that they would process the cancellation and would begin a refund.

Called Gatherings 800 number on February 19 at 10:45 AM EST and spoke with Carolyn (again). Was informed by her that the refund would be "done tonight". After waiting for another day nothing appeared to have been refunded. Contacted our bank and they confirm nothing was sent.

Called Gatherings 800 number again on February 21 at 5:45 PM EST and spoke with, you guessed it, Carolyn (yet again), and inquired about the refund and would like to speak with a supervisor. She said that the supervisor would call back my wife and gave them her cell number. No phone call ever came.

Called Gatherings 800 number again on February 22 at 4:30 PM EST and spoke with Carolyn again. Flat out asked her if she was the only one that worked there. She said supervisor would call but they have already left for the day. At 2:30 pm MST? It clearly states on their webpage that they open at 8:00 AM MST and close at 4:30 PM MST. Where do I sign up for that work schedule?
Email from them on February 24 stating that a credit had been issued to our Visa.

Called Gatherings 800 number yet again on February 25 at 10:04 AM EST and who do you think answered the phone? Our old buddy Carolyn. Again. We had to leave a message for a supervisor to call back again. No phone call was ever received.

Called Gatherings 800 number again on February 27 at 5:00 PM EST and spoke with Carolyn who said she would call us back on February 28 (today) in the morning to verify that the refund had gone through. No phone call ever came.

Received email from customer care stating that they had been trying to contact us at both my wife's cell number and our home number. I have been home all day and have gotten no such call.

Wife called Gatherings numerous times today and stated that if the money had not hit our account by Monday, March 3 other avenues would be pursued.
Complaint was sent to the BBB and this was posted here.
Was advised to contact the Attorney General's office both here and in Colorado.

Since the supervisor never seems to be there after, oh say noon, I will be calling Gatherings at 11:30 AM EST tomorrow (that's 9:30 AM MST, plenty of time for the individual to hit the phone even if they are late for work) February 29 to see if indeed a supervisor is there.
