Rip off migration fee

I am currently under contract with T-mobile, and I thought it was great when I saw the commercial they are advertising for unlimited talk for $49.99. So I call them up (I can never get someone who speaks english by the way, but no biggie)... And I let them know I want to change my plan. Everything sounds great until they start throwing in all these fees. They tell me that in order to change my plan, I have to pay a $35 migration fee first because I am on an annual contract, and in order to switch to the lower plan, I would be switching to a month to month contract. It sounded fishy, but then I thought well ok, atleast I will be on a month to month contract so I can cancel at anytime right? WRONG! They tell me, if I switch and I cancel before my annual contract date, I am still breaking my contract. This makes absolutely no sense. Actually they are charging me a fee in order to save money. So with T-mobile if your already a customer you have to pay a fee to save money on your bill. That's crazy! What kind of service is that? I'm upset and this should be illegal for them to do. Especially for them to word it as such, making it seem like you are switching to a month to month plan, when actually you are still under your contract which you cannot get out unless you pay the early termination fee, however they are claiming this migration fee is to prevent you from paying the early termination fee. I know confusing and it sounds like a bunch of bs! I'm very disappointed in T-mobile... And oh yeah, by the way they charge taxes on the $35 migration fee. I think she said something like $4 or $5 dollars on top of all the other bs taxes of course!
