Ripoff dishonest fradulent billing on credit card

I had taken dish network from Entertainment Unlimited Inc. (hereby referred to as EU)-a retailer for Dish on July 24, in Durham, NC. I had also entered into a 6 month contract with this company (attached). I went to Entertainment Unlimited and not directly to Dish, since I thought I would get more personalized service from a local retailer and not because Dish cannot directly install in an apartment.

I had to move to New Jersey in October to join my husband who got a job in the tristate area. On the first day of moving itself, I contacted Dish and asked them to install the equipment. However the dish person was unable to install the equipment on October 1st since there were too many trees blocking the signal. I could not shift into another apartment in that complex since none was available-the apartment management can confirm that. And I had already signed the lease agreement therefore I could not move apartment complexes.

I contacted John Dudley (Manager-EU) and asked him what to do, he advised that I have entered into a contract therefore I will have to continue to pay for 6 months of programming. I therefore never cancelled my A/c, which is still live and prepaid for six months of service. He however billed my Capital One Credit card A/c on that day itself for $540 for termination of contract.
I tried contacting him several times, but he refused to pick up my calls. I then contacted a friend of mine to contact him on behalf. He was very rude to him and told him that he cannot discuss the matter with him, my friend then told him to just pick up my calls. I contacted him again and he said that he will have to check whether my A/c is still live and whether I have prepaid for 6 months of service. And he also told me to return the receiver back to him, without which he cannot help me.

I did as he asked me and returned the receiver by US priority mail. For a week he said that he had not received the receiver. I finally traced the receiver-it had been received on his behalf by his neighbor, since he had been away on surgery.

He however now says that he agrees that I never canceled my A/c, that I prepaid for 6 months but since I returned the receiver back to him-there has been a breach of contract in 3 months time and therefore he will not reverse the charges (his rebuttal letter to merchant charge back enclosed).

This is totally unfair practice, since I returned the receiver back to him only since he had asked me to. I would never have prepaid for six months of service, kept my A/c live and still voluntarily violated the contract if he had not asked me to. I have even contacted Dish and they have confirmed that they have not billed anything to entertainment limited, therefore he should not suffer any losses.

Therefore I did exactly as Mr John Dudley asked me to do. He has unfairly billed me, he had assured me that he will reverse back the charges once I prepay for 6 months and send him the receiver back. Therefore there has been no violation of the contract-since the A/c is still live, it was never canceled, 6 months of programming has been pre-paid for and the equipment was returned only since he had specifically asked me to. I would not be stupid to keep the A/c live, prepay for 6 months of programming and still voluntarily return him the equipment thereby deliberately violating the contract.

Again to summarize I have not deliberately disconnected the equipment the dish company was unable to install it-a disconnection can happen only when there is an existing connection, I returned the equipment on John Dudley's request and I have prepaid for 6 months of service in November itself. I have therefore not violated the contract and the $540 charges should be reversed back on my capital one credit card. I have filed a complaint with Better Business Bureau. I hope as a small consumer my complaint will be listened to and appropriately addressed.
