Homes By Avi Unscrupulous means to dishonour contract Calgary Alberta

Sign on a contract with HomesbyAvi in Oct which included a clause for price protection in the event that they were to sell their home in the same area at a lower price.

This clause were added in as during the purchase of the new home, the real estate market is really slow and I'm hestitant to sign on the contract believing that the price will drop in a few months times. The sales manager who was eager to proceed with the house sales contract then agreed to add the price protection clause to give me the assurance that if the price were to drop, I will be given that protection. He also stated that the home prices or promotions will be completed on the first quarter of the following year.

The first quarter has now passed and the home they're selling on the area has dropped SIGNIFICANTLY. But when I asked them they keep giving excuses that the home is build last year and does not apply to my contract or that the home model was different from the one I signed hence does not apply. When i asked them further when the new price for the model will be done, they keep giving excuses that they are still working on it. Meanwhile the expiry for the price protection which is till end of April is coming up.

I can tell from speaking to the sales manager and his manager that they have no intention of honouring the contract. The manager even told me that the clause is not fair to their company. Well. Why didn't she said so when i sign it? I would have walked from the contract!
I should not have bought homes with HomesByAvi after reading the report on this website regarding "Leaky homesbyavi" on their stucco problems.
New home owners please take note of this builders and their fraudulent ways!
