I purchased vouchers for whale watching from LivingSocial. I waited until the fall to redeem my tickets, as that was the time when I was able to coordinate between the people invited on the trip, one of whom was flying in from out of town. I booked my tickets, but the trip was cancelled by the vendor due to weather conditions the night before the trip.
As the voucher is expiring tomorrow, the vendor agreed to extend the tickets until the summer. However, I purchased the tickets in order redeem them in the fall, and the vendor refuses to extend the tickets past June 30th.
LivingSocial refuses to accommodate my time constraints, and will not negotiate with the vendor to extend the voucher. Additionally, they refuse to refund the price of the voucher, stating that the terms and conditions stated that I must utilize the voucher or lose its promotional price. There is a clear misrepresentation of their terms and conditions in the "Fine Print" on their website, which I read prior to purchasing the voucher. I contacted LivingSocial twice by email, indicating that this was an urgent matter as the voucher was about to expire, yet they did not return my emails. I am still waiting for a call back from a manager.
LivingSocial is unwilling to work with the customer.in the terms and conditions of the contract, it states that the trip may be cancelled due to weather conditions, which is acceptable and fair. However, if a trip is cancelled for weather conditions, an equal replacement should be offered.instead, LivingSocial is requiring me to use the voucher for a trip which is of lesser value than the trip which I originally purchased (whale watching trips in the Spring/Summer are not equal to trips in the Fall - especially in the San Francisco Bay).
