Rip off

I asked Americredit to take my explorer back as I had nothing but trouble with it. I kept paying on the loan since 2006 and it never went down. They told me it would not affect my credit. Now they sent me a letter saying I owe them $12000 because they only got 4000 at the auction (not my fault). They also show a charge off on my crdit report for that amount. First of all my balance was not $16000 but around $13000. How did they come up with me owing $12000 on a 2005 ford Explorer when last year the insurance co. Paid over $7000 to put a new windshield in, fix the hood and repaint it after a tree fell on it??? Seems like they scam alot of people. Why isn't the governement going after them?
