Intent to fraud those who sign up for Gap Insurance

To those looking to buy a car from Saturn of Massapequa. Don't do it!

A few years ago I purchased a used car from Saturn of Massapequa. They sell some used cars that are not Saturn's. I bought a non-Saturn car.

I was informed by the salesman that a fee is charged if you elect to have GAP insurance for your vehicle. He also said that due to a New York State law my car would automatically be covered by GAP insurance. He instructed me to check the box on the form he gave me which states that I would not purchase GAP insurance for my vehicle. Due to his explanation I did not purchase GAP insurance.

Unfortunately, I was in a car accident a few months later and my vehicle was totalled. The only thing I could look forward to, at that point, was that I would not have to pay the bank for the remaining payments of my car. This is the benefit of having GAP insurance. It pays the GAP between what you have already paid and what you owe. This was a fact, at the time I financed my car, according to salesman at Saturn of Massapequa.

After the accident I checked with the bank that financed my car to make sure I would no longer be receiving bills for any remaining payments. They said that the story the salesman at Saturn of Massapequa told me was not true and that I was still responsible for making the remaining payments. This amounted to several thousand dollars.

I called Saturn of Massapequa and asked to speak with a manager. I explained the situation to him and he said he would get back to me. He called me back and said that the salesman that sold me the car never said that my GAP insurance would automatically be covered due to a New York State Law. I told him that I would see him in court. He said that I would lose the case because I already checked the box on the form stating that I did not elect to have GAP insurance coverage.

This left me stuck with a big bill that I had alot of trouble paying, but which I did pay in full. It would have cost me more to hire a lawyer to try the case than the remainng money I had to pay for my car due to the fraudulant statements made by Saturn of Massapequa.

I do not see how I can really win monetarily in this case. However, I would hope that due to my story and the exposure that usacomplaints.com provides, others that may want to buy a car at Saturn of Massapequa decide to shop elsewhere.
