Stalling to avoid paying claim

On Oct 26, a car crashed into my front yard and tore down a section of my fence. The owner of the car was insured by Safeway Auto Insurance. The driver of the car was a friend of the owner, and had no driver's license, nor could he read/write English, as he was Mexican, and probably here illegally. The owner of the car received c citation for allowing an unlicensed person to operate his vehicle. The driver received 3 citations-too fast for conditions, failure to maintain his lane, driving with no license. I filed my claim Oct 27. Within 10 days Safeway had sent someone to get an estimate for the damaged fence ($490). I have yet to hear back from anyone at Safeway, as they will not return my calls. They did send a letter stating that they would take no action, as there was a question of whether the driver of the car had permission to drive the vehicle (even though the owner of the car admitted to the police officer that he had loaned the car to his friend, an the car was not reported as stolen... Duhhhhhhh). I am currently checking into legal action against Safeway.
