Speedometers and odometers intentionally off by 5% or more

I recently brought my BMW 3 series in for routine service and some warranty items. Among my complaints was that the speedometer is off by an average of 5%, thus making the odometer off by as much. Since the speedometer reads "fast" it racks up the miles quicker, which means my warranty runs out quicker. When I wrote to BMW to explain my issue I was told that this is within tolerance for them. I also spoke to a service manager at a local dealership who explained this is a common complaint among owners but BMW won't do anything about it. At this point I am a minimum of 2424 miles closer to the end of my warranty because of this!
