Dealership with holding downpayment

Luzzi Suzuki keeping down payment when financing "failed to go through". Said they where charging $50 dollars a day and. 50 cents a mile instead, in other words keeping down payment money. Our copies of all paper work fail to show any such agreement for rental car charges if financing falls through. Finance Manager said that they were (not) charging for rental car expenses when we returned car. Didn't know dealership could even do such a thing. After waiting 12 days for our money, gave Luzzi a call and was then informed they had decided they were keeping all down payment monies after all. Finance manager said straight out we will "send check". Said one thing and turned around and did another. Finance Manager flat out LIED! To us. Can a authorized representative of dealership lie like that? Hope somebody can help us..
