Misrepesentation of verbal vs actual contract take a lawyer with you if buying a vehicle

On sept 18 i called by phone to hatch motor co in show low arizona to locate for me a 2007 or 2006 dodge ram 2500 series 4x4 4 door 8 foot bed pick up. Later that week i was contacted by phone by them stating that a vehicle which i had requested had been located. Me and the salesperson went over the equipment on the truck which had been located. It was what i wanted. I was told that the vehicle would have to be picked up in yuma arizona which would be done on friday september 21 which didn't happen on the 21st. We then discussed that the transaction would take place on monday, sept 24 which didn't happen. I called my salesman on tuesday am and was told that the vehicle was in the shop having the windows tinted and should be done later that day, i received a phone call from the salesman at 3:30 the 24th, he ask if I wanted him to deliver this vehicle to my house and i told him that would be fine but that i had to come into town and i would just pick it up, he said the vehicle would be detailed, all paperwork done and ready for me when i arrived, it takes me an hour driving time to the facility, i arrived there at 4:30. At the point nothing had been done, paperwork wasn't even started, my financing hadn't even been approved. I did not know any of this until much, much later. My salesman took me in the back to let me see the vehicle which at that time had all 4 doors open and the detail person was vacuming the vehicle.

We went back into the show room where i waited until 7:00 pm, the show room was closed, we had minimal lighting in the building, this is when the finance person came out with my paperwork to sign and this is also when i found out that the financing hadn't been approved by any lender. I said to the finance person as i had also said to my salesperson earlier that i thought i should come back another time when all was ready for me. At this time the finance person told me to go ahead and sign the contract and let them worry about the financing.in the beginning i had also told them who i wanted to go with and to not run my credit with a lot of lenders because i did not want the inquires on my credit report. I was told that they had a financial lender and would not use the one i wanted because they could get a better interest rate with the other. My reason for reporting this part leads us to my next paragraph.

After i had already signed the contract, i honestly did not see under body style on the contract 1500 which is a half ton not a 3/4 ton truck. I received my key (one key) and my sales person walked me out to the parking lot to my vehicle which was parked on the dark side of the lot next to the street, and i was wondering why they would not pull the vehicle in front of the building and why we walked through all the other cars for sale to get to my vehicle. The drivers side door was open and my sales person was showing me the instrument panel, which took about 5 to 7 minutes, then i drove away. After i arrived at my daughters house, she noticed before i got out of the truck that on the side of the vehicle it said 1500 series.

The next morning my daughter and i drove the vehicle back to the dealer spent most of the day there, was called into the general manager of new truck sales office at around 1 pm after i had to go looking for my salesperson because i was sitting in the waiting room and we were verbal until about 3 pm. Gentry hatch the general manger was very irritated and talked about everything except the fact that this was not the vehicle in which i ordered in the first place and insisted that i (i) did not understand anything about the deal and the contract that i had signed, my sales person sat also in the office with us, did not speak up or defend me. Mr. Hatch ask me what i thought he should do about this, i said find me the truck that i ask for and am paying for, which was also overcharged by about $10,000.00. My sales person told mr hatch that he "thought" he could get one from deming new mexico. Mr hatch was willing to use the vehicle that i had brought back with 30 miles on the odometer as a trade in on another vehicle and that one was manual package not the power package for interior controls. This 3/4 ton that they thought they could get for me was also priced higher than the 1/2 ton that was delivered to me. The sales person knew that i wanted and needed a 3/4 ton pick up.

This company has mis represented themselves, have lied to me in their own way and form of lying which i call sneaky lying and have totally ripped me off. The owner of this company called me yesterday - at least he said he was the owner - told me that i had signed the contract in good faith and they were doing nothing about the transaction. All i ask them to do is void the contract and start all over, work with me financially, so i could get the vehicle which i had ordered in the beginning. They are still making me look like the bad person and that i did not understand any of this transaction. My trade in was to be paid off at a rate of $23,279.76 which was a 2006 dodge 2 door st package, 4x4,3/4 ton (2500 series) with 33,633 miles and still under warranty. The charge for the 2007 dodge 1500 series, slt package, 4x4 with 8 foot bed price $42,278.76 with a $6000.00 factory rebate.
