Towbin Dodge
Deceptive sales practices

Miscellaneous

On April 26, I purchased a new 2003 Dodge Ram 2500. The bases of me making this purchase was the promise by the Salesman "Chris" that 0% at 60 month financing was available on this vehicle. The purchase agreement was approved by the Salesperson, the Sales Manager and the contract was approved and issued by the Towbin finance Department. I took possession of the vehicle and felt that all was said and done.

On Monday, May 12, I received a phone call from "Will" the General Manager of Towbin Dodge. Will stated that "they had made a mistake" and that they could not give me the 0% at 60 month financing that they promised and that I needed to come back in and redo the sales contract at a higher finance rate. When I said that I would not come back in, Will stated that they would not release the registration documents for the truck until I agreed to their terms.

On Thrusday, May 15, I received a certified letter from Towbin stating that I was to return the vehicle or have it repossessed at my cost, because "they could not get financing for me" even though my credit score was close to 800. Since I had already made over $600 in upgrades to the truck for towing purposes, I refused to return the truck and had to hide it from Towbin staff who patroled past my house.

Our investigation revealed that even though Towbin was advertising in newspapers and TV 0% at 60 months on all vehicles including the 2500 Ram, per a discussion with Dodge, it was not the true manufacture's incentives. Several of my co-workers called Towbin and were told over the phone by sales staff that the 0% at 60 months was available on this specific vehicle. Therefore, they could not offer this financing and used deceptive sales tactics to sell vehicles.

In an effort to keep the truck, I hired an attorney who, on Tuesday, May 20, sent Towbin a demand letter to honor their sales contract, release the registration docs and pay off my trade in (which they were holding), or be sued. On Thursday, May 22, Towbin Finance Manager Mr. Perez contacted my attorney and stated they would honor their agreement.

Overall, Towbin Dodge uses deceptive sales practices and out and out lies to sell vehicles. They use print and other media oulets to advertise promises they cannot keep. Also they claim to be a 5 Star Certified Dodge dealer, which according to the Manufacture they are not. Complaints were filed with the Nevada Department of Motor Vehicles, The Southern Nevada BBB and Dodge directly.
