At age 63, in Dec.'02, I underwent unexpected open heart surgery. I fell behind on payments. When I was able to make all back and current payments I called for the exact amount. Receiving the exact amount from Drive, I sent a money gram for the entire amount, following all Drive's instructions to the letter.

At the time I caught all payments up to date, I was living in the State of Nevada. The vehicle was in Grapevine, Texas at Texas Toyota. The car was where my son had taken it for service.

When we attempted to pick up the car from the Toyota store, the Service Manager informed my son that he no longer owned the car, the bank now owned it.

My wife had verified with Drive Servicing that they had received the Money Gram and the loan was current. But according to the Service Manager at Texas Toyota, the "Bank" had repossessed the vehicle some thirty days prior.

Drive Servicing violated the law on several issues according to Texas Law. The car just simply disappeared without notice of any kind. No accounting of when it was sold, no holding the car, per the law for the specified time in order to have a chance to redeem the vehicle. The car simply vanished.

The car was a 1996 Chevrolet Corvette with a Kelly Blue Book value in April, of $ 19,690.00. The balance owed after sending the Money Gram, was around $ 5,000.00.

Presently, there is a Cause of Action, (Cause No. 05-37290), filed in Tarrant County, Texas. The suit charges, Conversion/Theft, Conspiracy, Breach of Contract/Unfair Debt Collections/UCC Violations, Fraud/DTPA.

Since April, Drive Servicing continues to monitor my credit report on a regular basis.

I filed with Equifax a dispute on the repossession and the charge off that was showing. The next credit report after the filing of a dispute, Drive Servicing then showed, "Paid AS Agreed"!

On the Experian, my credit report shows specfically, over $ 19,000 charged off.

This whole incident with Drive Servicing, Drive Financial, First City Funding, or whatever they call themselves today, has been a very sad, stressfull, heartbreaking, and traumatic experience in my life, my wifes life, and the life of my son.

My young son, for whom I purchased the Vette for, was attending Baylor University, in Waco, TX, and will graduate in the spring of 2007. He and all of our family have been embarrased and humiliated by the illegal, criminal actions of Drive Servicing an their employees.
