's gliche in system charges $144 NSF fees. Ripoff! Lakewood CA

I have been a BOA customer since 1997 and today I was floored to receive notice that I had been charged $144 in NSF fees.

On 11/28/03 I deposited $250.00 in my account. Since this was on a Friday and after 2 PM, I knew per BOA employees that only $100 of that deposit would be immediately available to me the existing amount I had in my account. I was going to do my Christmas shopping and knew what I could spend and what I would have to wait on until the entire deposit cleared. I went later that evening and made 2 Debit card purchased. Both totaled around $88.00.

BOA said my deposit did not clear until 12/01/03. They charged me $56 for my $88.00 debit card puirchases on 11/28/03. This then compounded with additional purchases that I made after 12/01/03 unaware that my account was overdrawn.

When I got the notices from the bank, I called and asked the rep wasn't it true that $100 from a deposit is always available immediately with the remainded posting the next business day if before 2 PM and 2 days later is after 2 PM. The rep, Daniel Martinez unit # 8562 said "Yes it is true." I then asked him to look at what had happened and that by them not using that $100 in my account on 11/28/03, my account was incorrectly forced into overdraft with $144 in fees being charged and they even sent a $11.65 check back to wal-Mart.

He said there is a known gliche in the system, and they are aware of it and trying to corect it. I told him that they should help me out with the check fees and problems I would have with the check returned to Wal-mart. Daniel said they won't charge you fees. I explained I was sure they would. He told me to get something in writing from Wal-Mart saying they charged me a fee, and then take it to the bank branch and explain the situation to them.

I told him since this was not my error, it seemed that they could write a letter to wal-Mart for me and also send me something in wiriting that they had made a mistake. He said they were unable to do that, but that the very fact that they reversed and credited the fees back to me showed there was a bank error.

So I had to call Wal-Mart and now it's just a waiting game. They don't have the check back yet and they are having to try and also clean up a mess by BOA.

Daniel did admit to me that this was a known gliche in their system and I'm making you all aware of this. He said even though they tell us $100 is always available to us with a deposit, please note that until the gliche is fixed (no time given) we should never spend that money until we are certain the entire deposit has cleared.

This was and will continue to be a mess until I get it cleaned up.in the meantime, felt like I should share it with the rest of you.
