Vanderbilt Mortgage
Ripoff dishonest undermining harrassing

Business & Finance

My ex-husband and I financed a mobile home through SouthTrust in November 1996. We split up about 8 years ago, and I have been making the payments ever since. SouthTrust would not put the loan in my name and would not recognize my new married name.

Last year, the loan was sold to Vanderbilt. They too refused to recognize my married name, even though they told me all I had to do was provided them a copy of my marriage license, which I did. They continued to ask for me by my old name, and even continued to ask to speak to my ex, even though I had made it abundantly clear to them that he did not live there and had not made payments on the loan in years.

I also asked them to please transfer the loan into my name. They said I had a perfect payment record and that all I had to do was fill out a transfer of equity form. They lied. I was turned down.

So, I was still having to pay on this loan that had my ex-husband's name listed first. Statements with the interest paid had his name and social security number on them, keeping me from even being able to claim the interest I had paid on my taxes.

I found myself in very tight financial situation due to medical bills, was able to find a more affordable place to live, and told Vanderbilt that I would not longer make the payments on the mobile home - in writing. I also told them not to harrass me on my job.in my opinion if my money was good enough for them with his name on the loan, it should have been good enough with my name only on the loan.

Since that time, they have repeatedly called me at work, telling my receptionist that I am rude and hang up on them, ask to speak to my supervisor, and have lied, telling my receptionist that they were someone calling to see if the power was off at my home. Just this evening, they called my workplace after hours, and when my colleage asked to take a message, they told her she was very rude and again asked to speak to my supervisor. My personal business is of no concern to my boss.

On top of that, they keep calling my home, asking to speak to my ex-husband who has never lived at that residence. They have left countless messages for him on my answering machine and continuously harrass my new husband by asking for my ex. He keeps telling them that he does not live there and to stop calling and asking for him. We do not even know where he lives or have his phone number (and don't care to know for that matter). The real point is that they already know he doesn't live there.

What's really strange is there has been absolute no written notification of their intentions about this. I have already told them I can no longer pay on the loan. As far as I'm concerned they can come get the mobile home, and they have absolutely no reason to continue harrassing me and my family about it. Ironically, when they do call, they ask for me by my new name now. Funny how they wouldn't do that before.
