We were sold a timeshare/points vacation package. When they used the credit card for the down payment they put $1000 of it on the credit card and used the debit card used for security for the weeks stay for the other $1000.
They were to convert our previously owned timeshare into 254,000 points located at the ever popular Mrytle Beach, SC. This would give us VIP Gold Status. This never happened.
We could not schedule vacation 10 months in advance as we had only gotten our points January 1. Therefore, we lost all our points (182,000 points purchased, 182,000 bonus points, and the 254,000 points for the conversion).
We were promised by Patricia Peters that she would be our "Member Services Representative for many years and vacation adventures to come". She was to help us schedule vacations.information was given to her as to where we wanted to go and when. She was going to get it all fixed up and call us back. We never heard from her.
Wyndham will no longer accept our previously owned timeshare into their PIC program which deletes the 254,000 points and takes away our VIP Gold status.
We are currently working with The Owner's Advocate in Santa Barbara California. They are negotiating for cancellation of the contract and return of monies paid.
Today Wyndham made a settlement offer of cancelling the contract but refuse to give us back our $6942. We continue to negotiate.
If our monies are not returned with a cancelled contract we plan to bring suit against Wyndham. I have supporting documentation for each of our claims.
If you are dealing with this same problem, keep every piece of paper they send you. Document every telephone call, the person you spoke to, and the conversation.
Cancelling their non-enforceable contracts and getting all your money back is possible. Don't give up. I have also filed claims with the BBB, Florida Consumer Affairs, North Carolina Consumer Affairs, Attorney General Roy Cooper of North Carolina, and the Federal Consumer Affairs Consumer Help Website.
Keep fighting!
