Verbal Three Year Term Claimed to Charge $500 Cancellation

Does this sound familiar?
One day you got a phone call from Quest (now CL) and they asked you to switch over because they can give you a better deal. The deal sounds reasonable so you give them permission to switch. Down the road you find out that their internet service is way slower than what was promised and you upgrade the speed for more money but with no better result. Then after about two and a half years you decide to sign up with Comcast who just came to town asking much less money and 12 Mbps that is actually delivered!

So you cancel the service with CL and they charge you about $500 for early cancellation of a 3-year term agreement. Mind you, you never agreed to such terms but they insist you had. When asked to substantiate such a claim by supplying you with the signed contract, a recording of the actual deal, or a verbatim transcript, they simply refuse. You write letters, you offer arbitration, and they still refuse.
