Ripoff Misinterpretation of sale terms, contract and refusal to refund defective product

Purchased a Toshiba computer from Circut City Store #3142. The sound card and DVD burner on the computer were not functioning so it was recommended to return the computer for an exchange at the place of purchase.

Talked to a customer service manager named Seretta (very rude) who said they don't keep the product in stock any more so I have to buy a different product or pay a 15% restocking fee.

Called the (800) customer support line and was told that the store should return the merchandise for a full refund, however the store still refused to take the computer back. I continued my phone call until I reached the operations manager, Elaine. She said that they found a computer on stock and would be ready for pickup tomorrow.

About two hours later, Elaine calls me and says that the earliest the computer can arrive is on Monday. I have been waiting for a week to receive this fictional computer. I plan to file legal action.

Similarly, the warranty terms of a circuit city plan are misinterpreted. I suggest that eveyrone purchase a manufacturers warranty rather than a circuit city warranty that is overpriced and offers minimum protection.
