Created verbal contract without my knowledge $150.00 early termination fee

In November my husband and I got a shared plan with AT&T Wireless. We paid $59.99/mo for 500 anytime, 1000 night/weekend, and free mobile-mobile. It was a 2 yr contract. We were fairly happy with them until mid, when we began dropping a lot of calls and receiving outrageous bills due to 85 cents/minute overages caused by these dropped calls. We had the same service for a year and a half, why would we go over our time so much now? We begn to REALLY watch our conversations, and we KNEW we weren't going over, but continued to receive large bills. I called EVERY month to clear this up, but in the end, they argued so much I just paid them. We later found out this was due to their taking away our night minutes starting at 8PM, when I called, they claimed we never had them, just weekend. But we have sign-up paperwork that states otherwise.

In August an unfortunate lawn sprinkler incident fried my phone. We had 2 1/2 months left on our contract. We looked around for a new provider, since we were not happy with AT&T. However at that time, the closest thing with 2 phones started at $80. So we sucked it up, figuring at $30 savings a month, we could buy a new phone and just keep AT&T and suffer with the bad customer service.

We called 3 DIFFERENT TIMES to ask if we paid for a new phone, not a free offer, but paid for it, could we activate it and be month-to-month after November when our contract was up? 3 times the answer was YES.

So we went to AT&T Store and bought a Motorola V60i. We bought my husband a new $49 battery, and a $20 cover for my new phone. The total bill was over $250, leaving approx $180 for the price of the phone.

We have still had high bills in Nov, (they said it was the $35 new phone activation fee), Dec (we were out of state for Christmas for 3 weeks and didn't use hardly ANY minutes, yet they said we were over by 28, yet couldn't tell us at what point we exceeded our limit), Jan (haven't called on THAT one yet), Feb ($150 early termination fee). We are trying to port our numbers over to Qwest as of Feb 16.

WHAT??!!! Our contract was up in November, right?!! Wrong! When we bought the full-price phone at the AT&T store, we were supposedly offered a "special deal" and entered a "verbal contract" for a lower price of $166.25 in exchange for my number only to extend for one more year. WHAT!!?? How come I don't remember the sales guy saying this? I never signed anything. I have a receipt for $179. I have called them and been on the phone for an hour trying to straighten this out. No dice, they are sticking firm on this. I am going to contact the Attorney General's office and the FCC, I don't know if the BBB will do any good for the AT&T Store.

When I called the AT&T Store where I bought the phone, the guy said that there were no employees left there from last year, they were all new, that there had been a "cleen sweep". Does that mean that the sales guy pocketed the difference? I think that may be a possibility. I am NOT paying this ridiculous fee, and I will pre-emptively write the credit bureaus of any action taken by a colection agency. If there is anyone else interested in a class action suit against AT&T Wireless,
