Utility company ripoff deceptive company charges more then listed

Gexa advertises on their "Terms of Service" section for residential service a base charge of $3.00 per month. I got my first bill and the base charge was $4.79. I called to question this charge and was told that is was higher for apartment ($3.00 for a house). I looked at their Terms of Service and can find nowhere where it says that it is more expensive for an apartment. This is fraudulent advertising and I have already filed a complaint with the Public Utilities Commission of Texas.
