Failure to complete contract after taking money

Heritage Web Solutions was contracted in 2006 to design a website to specification and to work with me on design of said site. I paid Heritage Web Solutions a down payment of $1650.00. Once the process started I was advised it would take approximately 6 months to complete the database and design. I was advised I would have a designer assigned to me who I would be working with. A person who spoke very little English had contacted me; however his phone kept disconnecting, leading me to believe he was in another country. When I asked him if he was in the USA his phone disconnected and didn't hear from him again.

After bringing this to Heritage Web Solution's attention, I was then assigned another designer, and then another who shortly after had a baby, approx. 3 weeks later I was assigned a representative who was not the designer but a go between for ANOTHER DESIGNER. I had a couple conversations with her and believed my site was being worked on. Approx 8 to 9 months later I still didn't see any site and I called and complained. More time had passed and more calls made, and I finally had a website that did not even come close to specification and had many errors in it. I emailed all the issues and followed up with a call to Heritage Web Solutions.

Around June I called Heritage and advised I believe Heritage had no intention of fulfilling the contract and I was going to pursue legal action.
I was then contacted by person only identified as Josh who worked in their priority accounts. I spoke with him on the phone and advised him of what was going on. He had agreed that I fell through the cracks and couldn't believe what had occurred.

I asked for a refund and he stated he would talk to his supervisor and determine if that could be done. A short time after he contacted me via phone and advised that they could give me a refund or continue to build the site and waive the second payment of $1650. Since my goal was to have the website up and running I thought I would give them a second chance. BIG MISTAKE!

They sent me the exact same site that was not corrected or up to specification. They did not even attempt to correct items that I address approx 1.5 years prior. I kept my composure and again sent them what needed to be corrected. Josh advised that I would have a Top Notch program assigned and would contact me. To this date I have received nothing and they have $1650 of my money and I have nothing to show for it.

I contacted Josh at priorityaccounts005@hwsinet.com and advised that Heritage has still not complete the site, made any corrections, and a top notch programmer much less anyone from his company has yet to still call me. I advised I wanted a refund what was offered prior. Josh emailed me back and advised this:

I apologize for the delay, I have been out of the office. I am not exactly sure what happened at this point in moving forward, there were some steps in activating the account and "bringing it back to life" which have not been fully completed.

Again, since a majority of the programming work was done on this site, it would be my goal and HWS's to complete the site and move forward with a programmer to complete the changes needed. I would not be able to offer a refund on the account due to the database has been completed, along with design work on the account. This email was much of the same as I have been dealing with for almost 3 years. I feel it is a delay tactic in hopes I will just forget about it and go away.
