Unethical Collection Practices

In 2006 Alternative Revenue Services through their attorney, Timothy S. Gibson filed a lawsuit against me for collection after the 6 year stautory time limit to file suit. The summons was predated giving the appearance the suit was filed prior to the expiration of the statutory time limit. I was not properly served and on 1/27 the court entered a default judmgent which was recorded against our home. I filed an answer and motion to quash, the court vacated the judgment on 4/13/06. Which was the last I heard of it.

In March my husband and I were refinancing our home and through the process discovered Alternative Revenue Services had not released the judgment from the real property records even though the judgment was vacated. I called Mr. Gibson to advise him the judgment needed to be released and he told me his client must have filed it. I called the court to let them know and the clerk called Mr. Gibson to see what he intended to do about it. The court never heard back. Alternative Revenue Services refused to release the vacated judgment.in order to refinance I ended up having to pay off the false judgment.

In August I found the judgment was still against my home. After many telephone calls to Alternative Revenue Services I was able to obtain a Satisfaction of Judgment which I ended up recording. This is a total sham, unethical and probably illegal. Attorney Timothy S. Gibson was aware of the situation and did nothing to correct it, same with Alternative Revenue Systems. Be ware of these people and if necessary, as I did, call the Colorado Supreme Court and report Attorney Timothy S. Gibson and report Alternative Revenue Systems to the State of Colorado Attorney General's Office.
