Never finished pool, paid and have $10,000 dollars worth of work left

My girlfriend and I signed contract for installing pool, with a local Kingwood business Forest Mist Pools and Spas beginning of July. On the 13th of July ground was broken for the pool. As of today (11/30/07) pool is lacking concrete/spray deck, flagstone raised deck, Spa jets, Pebbletech finish on the pool, deck jets, cleaning equipment, replacement of flagstone coping (damaged by plumbers), correct placement of drainage spout (1), restoration of yard where construction was done, replacement of fence (torn down for construction) and equipment training. Eddie Stokes, the owner of Forest Mist Pools, assured us that all permits with the city and our home owner's association would be taken care of by him. Our permits with the city were denied because his checks bounced, which held up progress for a month. Mr. Stokes rectified this situation a month later. We received a letter from our home owner's association, stating that they had not received a permit application, Mr. Stokes told us on three separate occasions that he had just dropped off the forms with them. When we called our HOA, they said they had nothing on file, so we filled the permits ourselves. Mr. Stokes has not replied to numerous phone calls and emails for 3 weeks (as of 11/30/07). No work has been done on the pool in two and a half to three months. We have been contacted by the plumbers that were contracted by Mr. Stokes, to inform us that they would be placing a lien on our home, because Mr. Stokes has failed to pay them. We have also been contacted by the man that would finish the deck and the Pebbletech finish on the pool, he informed us that he would not be finishing our pool, due to the fact that he too has not been paid by Mr. Stokes for several jobs and cannot get in contact with him. Mr. Stokes had set up a schedule of payments, so that he was paid after stages of the pool were complete, we have, to date, paid all but $1500 of the $27,000 for the pool, per his schedule. The deck contractor has told us that the remaining work that needs to be done to complete the pool project will more than likely exceed $10,000. We have been contacted by 3 other customers of Forest Mist, here in Kingwood, that are in the same position, a couple (myself included) are filling suits against the company.
