Unfair Practices

I rented a home from a landlord who had a propane heating furnace and unfortunately Kelly's Propane was the name on the tank. I did not have the $2,500 to buy my own tank nor the $1,000 to get another company to come in and setup their tank facilities.

Being on a fixed income, I contacted Kelly's in January about a refill. I explained the meter on my tank read 10% at the time. I was quoted (approximately) $550.00 to fill it to the maximum of 80% capacity. I went to Kelly's and paid them in CASH.

Two days later, a driver came out to fill my tank. I got a phone call laster that week stating the driver "over filled" my tank and that I would have to PAY the difference. Taken aback, I explained that it was THEIR mistake and thus I should not have to pay anything. The clerk's first words were, "You can either pay it or we will close your account and repossess the tank!"

I then suggeste they send the guy out to remove the 10 gallons of fuel to which the reply went like, "Sorry, we won't do that. It's our policy to keep costs down so the responsibility is yours!"

Then I suggested to let the $25.00 amount ride until the next refueling which was also denied by the clerk.

(Being on a limited income really makes for a difficult situation)

I tried calling Kelly on various occasions and even asked the landlord to call on my behalf. No go. Kelly's accounting staff REFUSED to listen to reason.

In April, my tank was repossessed. Again due to Kelly's Propane own ADMITTED error!

Now Kelly's refuses to relinquish the difference of the remaining amount - $250.00 of fuel! They claim the landlord signed an agreement but he states he never did.

I explained to the accountant that by screwing over a customer for a mere $25.00 they are both unethical as well as stupid for not considering the long term benefits of future fill ups! In other words, they are penny wise but pound FOOLISH!

The bottom line is this: If you ever need propane in the Richland, Ashland, Morrow, Wayne or Knox county areas, be advised of said business practices by Kelly's Propane!
